  1. General
    1. This document is an electronic record in terms of the Information Technology Act, 2000 ("IT Act") and rules thereunder, and is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules 2011, which mandates for publishing of rules and regulations, privacy policy and terms of use for access or usage of the Website. This electronic record is generated by a computer system and does not require any physical or digital signatures.
    2. These Terms and Conditions / Terms of Service ("Terms" / TOS / Website Terms) read with the privacy policy, disclaimers, rules of Hungama as may be posted on this Website, having domain name www.hungamagamestudio.com (“Hungama Game Studio”), from time to time, shall govern your (the “Users”) use / access of the Website, ("Website"), its related content, sites and hyperlinks owned maintained and operated by Hungama Digital Media Entertainment Private Limited and or its Affiliates. Each user of Hungama Game Studio or any of the various products and services provided through the Hungama Game Studio application and/or this Website (the “Services”) are referred to as “you” and the owners of Hungama Game Studio and their affiliates are referred to as “we” or “us”.
    3. These Terms of Service govern your use of Hungama Game Studio including the use of all information, text, graphics, software, and services, available for your use on Hungama Game Studio. Use of the Service is also governed by our Privacy Policy and other relevant policies posted from time to time on the Hungama Game Studio website or as updates to the application, each of which is incorporated herein by reference.
    4. By using this website and Services, downloading any software, browsing the website on/or by Hungama Game Studio (from the Apple App Store, Google Play Store, Amazon App Store, Windows Phone Store, or any other website), you accept the following Terms of Service and our Privacy Policy.
    5. If you do not agree to these Terms of Service or any future updated version of them then you must not access or use Hungama Game Studio or its Services. If we require that any future update to these terms requires any action from you in order to accept the updated terms, then you may not be able to continue to use the Services until you have taken that action.
    6. We may amend the Terms of Service at any time, and the amended Terms of Service will be effective as soon as they are posted on this website. Subject to your agreement, and continuing compliance with these Terms of Service, and any other relevant Hungama Game Studio policies, Hungama Game Studio grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable limited license subject to the limitations below to access and use the Service for your own individual, non-commercial, entertainment purposes only. You agree not to use the Service for any other purpose. You may not sell, copy, exchange, transfer, assign or otherwise distribute anything you copy, create, buy or derive from the Service, unless you are expressly permitted by Hungama Game Studio.
    7. We reserve the right, at our discretion, to change, modify, add or remove portions of these Terms of Service at any time and without any notice. We also reserve the right to terminate or restrict access to Hungama Game Studio and the Services for any reason whatsoever at its sole discretion.
    8. We may partner with other companies (“Reward Partners”) to allow you the opportunity to exchange rewards points earned or purchased on Hungama Game Studio (including Virtual Currency and other Virtual Items) into rewards points that may be used with any of our Rewards Partners. Any rewards points so exchanged and the terms upon which they may be exchanged are subject to the terms and conditions published by our Rewards Partners from time to time. All such reward points are subject to the terms and conditions published by the relevant Reward Partners from time to time on their website, including the terms upon which those rewards points may expire if not redeemed. We accept no liability to accept or redeem reward points issued by our Rewards Partners, and all such liabilities remain solely with our Reward Partners except to the extent expressly set forth on this website.
    9. You acknowledge and agree that we may update Hungama Game Studio or the Services with or without notifying you. We may require that you accept updates and you also may also need to update third party software from time to time in order to access Hungama Game Studio or receive the Services. We conduct maintenance work from time to time. A portion, or sometimes all, of the features of Bollywod Boss and the Services will not be available during maintenance periods.
  2. Accessing and Using the Services:
    1. You are responsible for the internet connection and any mobile or other charges that you may incur for accessing or using the Services. You should ask your mobile operator or internet service provider if you are unsure what these charges will be before you access or use the Services.
    2. You may have an Account and/or you shall use the Service if you are a “natural person” (as opposed to any kind of legal entities like a corporation, limited liability company, etc.), and you affirm that you are the legal age of majority in your country of residence. If you are not, your legal guardian must review and agree to these Terms of Service. You accept full responsibility for any unauthorized use of the Service by minors. You are responsible for any use of your credit card or other payment instrument (e.g. PayPal) by minors.
    3. You are responsible to assure that your use of Hungama Game Studio complies with the laws of the jurisdiction in which you are located. For example, if you are in a country that has a higher age requirement than 18, you must comply with those local age requirements.
    4. Downloading and use of Hungama Game Studio or any of the Services offered is done at your own discretion and risk and you are solely responsible for all damage to your device system, loss of data, or other harm that results from such activities.
    5. Our games do not offer real money gambling or an opportunity to wager or win currency. Game points, prizes and awards for which they may be redeemed or which are otherwise associated with Hungama Game Studio (including any Virtual Currency or other Virtual Items you may receive, even though referred to as coins or using other monetary terms) are awarded solely for time of play, watching advertisements or other factors that do not relate to the skill with which the Games are played or other elements of games of chance. Game points have no cash value, and we will not give you cash in exchange for game points or other prizes or awards you receive for playing Hungama Game Studio.
  3. Accounts :
    1. When using the Services you may choose to, and in some instances you will be required to, create an account with us. If you access the Service from a Social Networking Site ("SNS"), such as Facebook or Google+, you shall comply with its terms of service/use as well as these Terms of Service. If you create an account with us, you agree that you shall take all steps necessary to protect your log in details and keep them secret. We are not responsible for any breach of security caused, in whole or in part, by your failure to take these steps.
    2. You agree that you shall not give your log in details to anyone else or allow anyone else to use your log in details or account. We will not be responsible to you for any loss that you suffer as a result of an unauthorized person accessing your account and/or using the Services and we accept no responsibility for any losses or harm resulting from its unauthorized use, whether fraudulently or otherwise.
    3. Hungama Game Studio reserves the right to terminate any account that has been inactive for 180 days
    4. Hungama Game Studio reserves the right to stop offering and/or supporting the Service or a particular game or part of the Service at any time, at which point your license to use the Service or a part of the Service will be automatically terminated. In such event, Hungama Game Studio shall not be required to provide refunds, benefits or other compensation to users in connection with such discontinued Services. Termination of your Account can include disabling your access to, or any part of, the Service including, but not limited to, any content you or other users have submitted.
    5. YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN ANY ACCOUNT THAT YOU CREATE USING ANY OF OUR SERVICES. WE MAY SUSPEND, TERMINATE, MODIFY OR DELETE ANY OF THESE ACCOUNTS AT ANY TIME FOR ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE TO YOU.
  4. User conduct and content
    1. “User Content” means any communications, images, sounds, and all the material, data, and information that you upload or transmit through a Hungama Game Studio game client or the Service, or that other users upload or transmit, including without limitation any chat text. By transmitting or submitting any User Content while using the Service, you affirm, represent and warrant that such transmission or submission is (a) accurate and not confidential or misleading; (b) not in violation of any laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content; (c) free of viruses, adware, spyware, worms or other malicious code; and (d) you acknowledge and agree that we will process any of your personal information within such content in accordance with the Privacy Policy. You consent to the collection, use and storage of your information as outlined in the Privacy Policy.
    2. You may be required to register an account (the “Account”) with us to use Hungama Game Studio. Your use of Hungama Game Studio and the Services are subject to the “User Conduct Policy” described in Section 4.3. You are entirely responsible for knowing, understanding, and abiding by the User Conduct Policy. The User Conduct Policy is not exhaustive, and we reserve the right to determine which conduct is considered to inappropriate and to take disciplinary measures, including the termination and deletion of user Accounts, prohibiting user from using the Hungama Game Studio or the Services in whole or in part. The User Conduct Policy governs all aspects of your interaction with Hungama Game Studio and other Users, including, without limitation, selecting an in-game name, posting messages and interacting with other Users.
    3. You agree that you will not violate the terms of the following provisions of this Section (the “User Conduct Policy”). You will not:
      • Use the Services to harm anyone or to cause offence to or harass any person;
      • Transmit or post any content or use offensive or defamatory language (or language deemed by us to be offensive or defamatory in our sole discretion);
      • Use the Services for fraudulent or abusive purposes (including, without limitation, by using the Services to impersonate any person or entity, or otherwise misrepresent your affiliation with a person, entity or the Services);
      • Post or make available to the public any other user’s personal information on Hungama Game Studio or any related Service without that User’s express written consent;
      • Use another person or entity’s email address in order to sign up to use the Services;
      • Share your password or any credentials you may use to access your Account with anyone;
      • Purchase, sell, rent, or give away your Account, or otherwise make available your Account to any third party; create an Account using a false identity or information, or on behalf of someone other than yourself;
      • Use your Account for commercial purposes, including but not limited to advertising, or solicitation, or transmission of any commercial advertisements (junk or spam emails, chain letters, etc.);
      • Remove or amend any proprietary notices or other ownership information from Hungama Game Studio or any other part of the Services;
      • Attempt to decompile, reverse engineer, disassemble or hack any of the Services, or to defeat or overcome any of our encryption technologies or security measures or data transmitted, processed or stored by us;
      • Use the Services in violation of any applicable law or regulation;
      • Use the Services to cheat or design or assist in cheating (for example, by using automated means or third party software to play), or to otherwise circumvent technological measures designed to control access to, or elements of, the Services, or to do anything else that a reasonable person is likely to believe is not within the spirit of fair play or these terms;
      • Violate the contractual, personal, intellectual property, or other rights of any party, or promote or constitute illegal activity;
      • Improperly use Hungama Game Studio’s support services, including without limitation submission of false reports of abuse or misconduct by any party;
      • Interfere with or disrupt the Services or servers or networks that provide the Services;
      • Engage in cheating, other fraudulent activity or other conduct we deem inappropriate;
      • Use or take part in the use of any unauthorized third-party software designed to modify or interfere with Hungama Game Studio or the Services; or
      • Use Hungama Game Studio or the Services in any other way not permitted by these terms.
    4. ANY RESEMBLANCE TO ACTUAL PERSONS, LIVING OR DEAD OR ACTUAL EVENTS OR IP CHARACTER, UNLESS OTHERWISE SPECIFIED IS PURELY COINCIDENTAL AND IMAGINARY.
    5. YOU ARE SOLELY RESPONSIBLE FOR ALL OF YOUR COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF HUNGAMA GAME STUDIO AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SERVICES. YOU UNDERSTAND THAT WE DO NOT SCREEN OR INQUIRE INTO THE BACKGROUND OF ANY USERS OF THE SERVICE, NOR DO WE MAKE ANY ATTEMPT TO VERIFY THE STATEMENTS OF USERS OF THE SERVICE. WE MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS OF HUNGAMA GAME STUDIO OR THE SERVICES OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE USERS OF THE SERVICE. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SERVICES, PARTICULARLY IF YOU DECIDE TO MEET OFFLINE OR IN PERSON.
    6. The User Conduct Policy provides us with the right to terminate your use of Hungama Game Studio, the website or other associated features, however it does not create any obligation on our part to monitor or enforce the User Conduct Policy in order to prevent violations. You bear the risk that other Users may offend you or otherwise harm you by means of their violations of the User Conduct Policy. While we intend to apply the User Conduct Policy to regulate use of Hungama Game Studio to assure a wholesome safe environment, the User Conduct Policy will not be construed to create rights in favor of any User or duties to any User on behalf of Hungama Game Studio or its owners. The maintenance of materials posted by Users on the website or through Hungama Game Studio will not be deemed to constitute our re-publication of that information.
  5. Fees
    1. Purchases :
      • As part of the Service you may purchase, with “real world” money, a limited, personal, non-transferable, non-sublicensable, revocable license to use:
        • (a) “virtual currency” (“Virtual Currency”);
        • (b) “virtual in-game items” (together with Virtual Currency “Virtual Items”); and
        • (c) other goods or services (“Entitlements”).
    2. You may also obtain a license to use Virtual Items and/or Entitlements by redeeming third party virtual currency such as FacebookTM credits or TapjoyTM exchanges.
    3. Hungama Game Studio may manage, regulate, control, modify or eliminate Virtual Items and/or Entitlements at any time, with or without notice. Hungama Game Studio shall have no liability to you or any third party in the event that Hungama Game Studio exercises any such rights.
    4. The transfer of Virtual Items and Entitlements is prohibited except where expressly authorized in the Service. Other than as expressly authorized in the Service, you shall not sell, redeem or otherwise transfer Virtual Items or Entitlements to any person or entity, including, but not limited to, Hungama Game Studio, another user or any third party.
    5. VIRTUAL ITEMS AND ENTITLEMENTS CAN NEVER BE REDEEMED FOR REAL MONEY, GOODS, OR ANY OTHER ITEM OF MONETARY VALUE FROM HUNGAMA GAME STUDIO OR ANY OTHER PARTY. YOU UNDERSTAND THAT YOU HAVE NO RIGHT OR TITLE IN VIRTUAL ITEMS OR ENTITLEMENTS.
    6. ALL PURCHASES AND REDEMPTIONS OF THIRD PARTY VIRTUAL CURRENCY MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE.
    7. If you are a consumer who resides in the European Union, you have the right to cancel the purchase of a license to use Virtual Items and Entitlements within seven (7) working days after the date of purchase (“Cooling Off Period”). However, this right to cancel is lost once if the supply of the Virtual Items or Entitlements begins before the end of the Cooling Off Period. As the supply of the Virtual Items and Entitlements begins promptly after you purchase a license for Virtual Items and Entitlements, you acknowledge that by agreeing to purchase any such license you lose your right of cancellation.
    8. Payment of Fees
      You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. Hungama Game Studio may revise the pricing for the goods and services offered through the Service at any time. Hungama Game Studio may also provide links to other websites or third party services, some which may charge separate fees, which are not included in any fees that you may pay to Hungama Game Studio. Any separate charges or obligations that you incur in your dealings with third parties are your responsibility.
      YOU ACKNOWLEDGE THAT HUNGAMA GAME STUDIO IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.
  6. Intellectual Property
    1. We reserve all copyrights, trademarks, and all other proprietary rights shown in the content of Hungama Game Studio and the Services (including, but not limited to, software, games, services, computer code, text, themes, characters, character names, stories, dialogue, documentation, animations, sounds, graphics, and logos). All such rights are protected by international copyright laws. You agree not to copy, republish, modify, download, distribute, license, sublicense, reverse engineer, or create derivatives based on the site, its software, or its services except as expressly authorized herein. Any other use of the content, including, without limitation, distribution, reproduction, modification, display, or transmission, without our prior written consent is strictly prohibited. All copyright and other proprietary notices shall be retained on all reproductions. We reserve all rights, including without limitation, all intellectual property rights or other proprietary rights associated with Hungama Game Studio or the Services.
    2. The Service and each element of the Service, including all associated intellectual property rights, Hungama TM, and Hungama Game Studio TM are the exclusive property of Hungama and its licensors. You must comply with all laws that apply to you when accessing or using the Service and each element of the Service. You will not remove, alter or obscure any copyright, trademark or other proprietary rights notices incorporated in or accompanying the Service.
    3. Digital Millennium Copyright Act (“DMCA”) Copyright Infringement Notification
      • Hungama Game Studio respects the rights of others and expects you to do the same, particularly with regards to copyright law. Therefore, Hungama Game Studio responds to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”) and will terminate the Account of anyone Hungama Game Studio believes to be a repeat infringer of the rights of copyright holders.
      • If you are, or an agent of, a copyright owner, and you believe that any content hosted by Hungama Game Studio infringes your copyrights, then you may submit a notification pursuant to the DMCA (see Section 17 U.S.C. Section 512(c)(3)). Specifically, you must submit to the Hungama Game Studio Copyright Agent the following information:
        • (a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright
        • (b) a description of the copyrighted work that you claim has been infringed;
        • (c) the URL of the location on the Hungama Game Studio’s website or other location containing the material that you claim is infringing;
        • (d) your address, telephone number, and email address;
        • (e) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
        • (f) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

  7. Disclaimer of Warranties and Duties:
    1. We have no special relationship with or fiduciary duty to you. You acknowledge that we have no control over, and no duty to take any action regarding which Users gain access to Hungama Game Studio or the Services; what content you access via the Hungama Game Studio or the Services; what effects Hungama Game Studio, the Services or the content accessed through them may have on you; how you may interpret or use the content accessed Hungama Game Studio or the Services; or what actions you may take as a result of having been exposed to Hungama Game Studio or the Services. We make no representations concerning any content contained in or accessed through Hungama Game Studio or related Services and will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed Hungama Game Studio.
    2. ALL INFORMATION, SOFTWARE, GAMES, AND SERVICES OFFERED ON THIS WEBSITE ARE PROVIDED "AS IS." WE EXPRESSLY DISCLAIMSALL WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  8. Limitations of Liability:
    1. In no event shall we be liable for any loss or damages (including without limitation of any direct, indirect, punitive, special, incidental or consequential loss or damage) resulting from:
      • Access to Hungama Game Studio, the Services or inability to access to them;
      • Any third party's conduct, content, information or data;
      • Any unauthorized access to or use of Hungama Game Studio the Services or any and all personal, private or other information stored therein;
      • Losses or harm not caused by our breach of these terms or our gross negligence or actual misconduct;
      • Losses or harm which are not reasonably foreseeable by you and us at the time of you agreeing to these terms and conditions including those losses which happen as a side effect of foreseeable losses. This could include loss of data, loss of opportunity, service interruption, computer or other device failure or financial loss;
      • Any damage that may be caused to any device on which you access or use of Hungama Game Studio or other Services that is caused in any way by the Services unless that damage is directly caused by our failure to exercise reasonable skill and care in the provision thereof;
      • Any increase in loss or damage resulting from breach by you of any of these terms and conditions; or
      • Technical failures or the lack of availability of Hungama Game Studio or any of the Services.
  9. Applicable Law:
    1. These Terms of Service and all disputes relating to them shall be governed by and construed in accordance with the laws of India and shall be subject to the exclusive jurisdiction of courts in Mumbai, India.
  10. Severability:
    1. If any portion of these Terms of Service or Privacy Policy is found illegal or unenforceable, in whole or in part, by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective solely to the extent of such determination of invalidity or unenforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without affecting the remaining provisions of the terms, which shall continue to be in full force and effect.
  11. Transferring these terms:
    1. We may assign or delegate our rights and obligations under these Terms of Service and the Hungama Game Studio Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without Hungama Game Studio's prior written consent, and any unauthorized assignment and delegation by you is ineffective.
  12. Supplemental Policies:
    1. We may publish additional policies related to specific services (including but not limited to forums, contests, or loyalty programs). Your right to use such services is subject to those specific policies and these Terms of Service.
  13. Support and Contact:
    1. YOU AGREE THAT YOUR USE OF THE INFORMATION, CONTENT, OR SERVICES ACKNOWLEDGES THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.

  14. Facebook Disclaimer:
    1. You agree and acknowledge, as condition of participating in the Service, that Facebook® (“Facebook”) does not sponsor, endorse, administer, and is in no way associated with, the Service. All questions regarding the Service must be directed to PLAYSTUDIOS, not Facebook. You also agree that as a condition of participating in the Service you shall release Facebook® from any and all liability arising out of your participation in said Service.
  15. Song Beat Specific Terms
    1. Song Beat Content
      Song Beat and all the content included in Song Beat is referred to as “Song Beat Content”. Song Beat Content includes music, artwork, metadata and other content, intellectual property rights and materials that are owned by people other than Hungama Game Studio (such as other music companies, together referred to as “Song Beat Licensors”). On behalf of the Song Beat Licensors, Hungama Game Studio reserves all rights (which means you are not permitted to use all rights) in the Song Beat Content that are not granted to you in these Terms of Service.
    2. Complying with Laws
      You must comply with all laws that apply to you when using Song Beat Content, including all copyright laws that apply in the country where you live. You must not infringe (which means using without a licence or other form of legal permission to use) any intellectual property rights that exist in Song Beat Content, including the rights of the copyright owner(s) of the sound recordings included in Song Beat.
    3. Using Song Beat
      You must only use Song Beat:
      • as permitted in these Terms of Service; and
      • for your individual, personal, non-commercial use.
    4. You must not:
      • use or try to use the music or other content included in Song Beat separately from Song Beat (unless you have obtained a licence or other form of legal permission to do so);
      • share or transfer Song Beat Content (including any music or sound recordings) to other people; or
      • modify, edit or repurpose Song Beat Content.
    5. Neither Hungama Game Studio nor any Song Beat Licensor grants you any commercial, sale, resale, reproduction, distribution or promotional use rights for the Song Beat Content, or any rights to include Song Beat Content in other content or projects (these rights are known as “synchronisation rights”) or to perform Song Beat Content in public (these rights are known as “public performance rights”).
    6. You are specifically prohibited from making any physical or digital copies of Song Beat Content and from selling or distributing Song Beat Content unless you have obtained a licence or other form of legal permission to do so. This copying, selling and distributing may violate the laws that apply to you.
    7. Song Beat Usage Data
      As far as permitted by privacy laws, Space Ape may share data relating to your use of Song Beat with Song Beat Licensors.
    8. Violation of Terms
      If you repeatedly violate these Terms of Service, Hungama Game Studio may suspend, restrict or terminate your access to Song Beat.
